ITEM 7: REISSUANCE OF NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM (NPDES) PERMIT FOR THE DISCHARGE OF STORM WATER ASSOCIATED WITH INDUSTRIAL ACTIVITY (GENERAL NPDES INDUSTRIAL STORM WATER PERMIT)

DISCUSSION: The Federal Clean Water Act [Section 402 (p)] requires industries to obtain NPDES permits for discharge of storm water from industrial facilities. The U.S. Environmental Protection Agency (U.S. EPA) adopted regulations (see Federal Register, Volume 55, No. 222, Friday, November 16, 1990) that identify the categories of industrial facilities which are required to be permitted. Generally, the industries that are required to obtain permits for storm water discharges are industrial facilities subject to storm water effluent limitation guidelines; manufacturing facilities; mining facilities; hazardous waste treatment; storage; or disposal facilities; landfills; recycling facilities; steam electric power generating facilities; transportation facilities; sewage or wastewater treatment works; and certain manufacturing facilities at which materials are exposed to storm water. This permit does not include construction activities, which are regulated by a separate general permit.

The State Water Resources Control Board (SWRCB) adopted a General NPDES Industrial Storm Water permit in conformance with these regulations on

November 19, 1991 and subsequently amended on September 17, 1992. In accordance with the Federal NPDES permit regulations, this General Industrial Permit expired on November 19, 1996. (This existing General Industrial Storm Water Permit will remain in effect until it is reissued by the SWRCB.)

A public hearing was held on November 12, 1996 to receive comments on a proposed General NPDES Industrial Storm Water Permit that would, if adopted, replace the existing General NPDES Industrial Storm Water Permit. All comments have been received and considered. Appropriate changes have been made to the General NPDES Industrial Storm Water Permit which was the subject of the November 12, 1996 public hearing.

POLICY ISSUE: Should the SWRCB adopt an order reissuing the General NPDES Industrial Storm Water Permit?

FISCAL IMPACT: The State and Regional Board activities associated with the Storm Water Program have been provided for through the normal budgeting process.

REGIONAL BOARD IMPACT: No. The adoption of an order reissuing the General BOARD NPDES Industrial Storm Water Permit will have no measurable affect on current Regional Board activities.

STAFF RECOMMENDATION: That the SWRCB: Adopt an order reissuing the General NPDES Industrial Storm Water Permit.
