ITEM 8: CONSIDERATION OF A RESOLUTION TO AUTHORIZE THE EXECUTIVE DIRECTOR, OR HIS DESIGNEE, TO AMEND THE INTERAGENCY AGREEMENT WITH THE DEPARTMENT OF FISH AND GAME FOR THE BAY PROTECTION AND TOXIC CLEANUP PROGRAM'S MONITORING SERVICES

DISCUSSION: The Bay Protection and Toxic Cleanup Program (BPTCP) is required by the Water Code (Section 13390-13396.7) to monitor the State's enclosed bays and estuaries to identify toxic hotspots and plan for their cleanup. The California Department of Fish Game (DFG) is the primary contractor for monitoring services for the BPTCP.

The State Water Resources Control Board (SWRCB) staff will continue to implement the monitoring contract with DFG to provide the necessary monitoring services. Seven coastal Regional Water Quality Control Boards (RWQCBs) implement regional monitoring for the BPTCP through task orders developed in coordination with DFG and SWRCB staff. In the final year of the BPTCP, DFG will prepare written reports on all monitoring data. A portion of the funds shall be used for statistical analysis and to complete a limited number of measurements on archived samples.

The interagency agreement now in effect will be amended to increase the contract amount by $600,000 for FY 1997-98 to complete final program monitoring reports. The contract dollar amount will increase to a total of $2,895,159. Since FY 1997-98 will be the final year of the BPTCP, a new contract will not be prepared.

POLICY ISSUE: Should the SWRCB authorize the Executive Director, or his designee, to amend the existing interagency agreement with the DFG.

FISCAL IMPACT: The proposal would provide an additional $600,000 to DFG for monitoring report preparation. The funding for FY 1997-98 is subject to the availability of funds from the BPTCP annual fees, and shall not exceed a total of $2,895,159.

RWQCB IMPACT: Yes. The seven coastal RWQCBs.

STAFF RECOMMENDATION: That the SWRCB should authorize the Executive Director, or his designee, to amend the interagency agreement with the DFG to increase the total contract amount by $600,000 to complete final monitoring reports.

AUTHORIZATION TO THE EXECUTIVE DIRECTOR, OR HIS DESIGNEE, TO AMEND THE INTERAGENCY AGREEMENT WITH THE DEPARTMENT OF FISH AND GAME FOR THE BAY PROTECTION AND TOXIC CLEANUP PROGRAM'S MONITORING SERVICES


WHEREAS:

1. The Bay Protection and Toxic Cleanup Program (BPTCP) was established by the State Water Resources Control Board (SWRCB) to implement the requirements of Section 13390 et seq. of the Water Code which include the development of surveillance and monitoring programs for enclosed bays and estuaries of the State.

2. Seven coastal Regional Water Quality Control Boards (RWQCB) and the SWRCB implement regional monitoring for the BPTCP through an interagency agreement with the Department of Fish and Game (DFG).

3. The current interagency agreement is a task order contract.

4. The amount of the interagency agreement now in effect needs to be increased by $600,000, from $2,295,159 to $2,895,159, to complete program monitoring reports. A portion of the funds shall be used for statistical analysis and to complete a limited number of measurements on archived samples.


THEREFORE BE IT RESOLVED THAT:

The SWRCB authorizes the Executive Director, or his designee, to amend the interagency agreement with the DFG to increase the contract by $600,000 for FY 1997-98 subject to the availability of funds from the BPTCP annual fees.
