ITEM 6: REQUEST FROM THE CALIFORNIA REGIONAL WATER QUALITY CONTROL BOARD, CENTRAL VALLEY REGION, FOR $24,000 FROM THE STATE WATER POLLUTION CLEANUP AND ABATEMENT ACCOUNT (ACCOUNT) TO CONTINUE CAA PROJECT C/A 134 FOR OVERSIGHT OF THE TURLOCK PCE REMEDIATION PROJECT THROUGH JUNE 30, 2000.

DISCUSSION: On December 5, 1997 the Regional Water Quality Control Board, Central Valley Region, (Regional Board) adopted Resolution No. 97-265 which authorized the Executive Officer to apply to the State Water Resources Control Board (State Board) for $24,000 from the Account to continue CAA Project C/A 134 for oversight of the Turlock PCE remediation project through June 30, 2000.

The Resolution 97-265 provides a brief description of the Regional Board's agreement with the City of Turlock as well as a description of the work accomplished, and the additional Regional Board staff work that must be done to complete the PCE remediation.

In November 1994 the State Board approved C/A 134 and allocated $22,500 for Regional Board staff oversight of the PCE remediation. These funds have been expended.

POLICY ISSUE: Should the State Board approve $24,000 from the Account to fund the request made by the Regional Board.

FISCAL IMPACT: As of November 1, 1997 the Account had a cash balance of $6,062,662, and there is $11,855,600 committed to cleanup and abatement activities. Although the Account is over committed, most funds will be disbursed over extended periods and we are confident the Account will maintain a positive cash balance at all times. An additional commitment of $24,000 over the next thirty months should not jeopardize the security of the Account.

RWQCB IMPACT: Yes, Central Valley Region.

STAFF RECOMMENDATION: We recommend that the State Board adopt the proposed resolution approving a commitment of $24,000 and extend the project through June 30, 2000.

RESOLUTION NO. 98 -

APPROVAL OF FUNDS FROM THE STATE WATER POLLUTION CLEANUP AND ABATEMENT ACCOUNT FOR THE CENTRAL VALLEY REGIONAL WATER QUALITY CONTROL BOARD TO CONTINUE OVERSIGHT OF THE TURLOCK PCE REMEDIATION PROJECT

WHEREAS:

1. In 1994 the Central Valley Regional Water Quality Control Board (Regional Board) entered into an agreement with the City of Turlock wherein the City agreed to investigate the PCE plume(s) in the ground water beneath the City and to prepare and implement a long-term ground water management plan to contain those plume(s) and optimize extraction of PCE from the ground water for the life of the plan: and

2. In November 1994 the State Board approved $22,500 from the State Water Pollution Cleanup and Abatement Account (Account) for Regional Board oversight of investigation and remediation of PCE ground water pollution in the City (CAA Project C/A 134); and

3. The City prepared an investigation work plan, conducted soil gas survey and sampling of existing monitoring wells, prepared a report of the findings, and prepared a Phase III work plan which calls for monitoring well installation, deep profile borings, sampling monitoring wells, and submittal of a Phase III report of findings; and

4. The Regional Board has expended the funds allocated in 1994 overseeing the work described above but will need to review the Phase III investigation report, and draft and final ground water management plans, and oversee implementation of the final plan; and

5. The Regional Board has requested $24,000 from the Account to complete oversight of the City's PCE remediation project through June 30, 2000; and

6. The Account is currently over committed but it has been determined that an additional commitment of $24,000 through June 30, 2000 will not jeopardize the security of the Account.

THEREFORE BE IT RESOLVED THAT:

THE STATE WATER RESOURCES CONTROL BOARD:

1. Allocates $24,000 from the Account to continue Regional Board staff oversight of the City PCE remediation project (C/A 134).

2. The project period for C/A 134 is extended to June 30, 2000.
