SUBJECT: CONSIDERATION OF A PROPOSED RESOLUTION AUTHORIZING THE EXECUTIVE DIRECTOR TO AMEND AN INTERAGENCY AGREEMENT WITH THE DEPARTMENT OF FISH AND GAME TO ADD FUNDS FOR EQUIPMENT FOR THE STATE MUSSEL WATCH PROGRAM IN FISCAL YEAR (FY) 1997-98
DISCUSSION:

The State Water Resources Control Board's (SWRCB) State Mussel Watch Program (SMWP), initiated in 1976, is designed to detect the presence and concentration of toxic pollutants in mussels and clams in estuarine and marine waters. The Department of Fish and Game (DFG) has satisfactorily operated the field collection and laboratory aspects of the SWRCB's SMWP in accordance with interagency agreements for 21 years. The current SMWP agreement with DFG expires on June 30, 1998.

Senate Bill No. 62, approved by Governor Wilson on October 7, 1997, added Section 13177 to the Water Code requiring the SWRCB, in conjunction with the DFG, to continue to implement the SMWP to the extent funding is appropriated for this purpose. The sum of one hundred forty-five thousand dollars ($145,000) from the General Fund is also included in the bill to be used for the SWRCB's SMWP.

Staff is requesting authorization to add the $145,000 appropriated in the bill to the existing SMWP contract with DFG. The funds will be used to replace old and obsolete equipment, including field sampling equipment, laboratory analytical instruments, and computers.

POLICY ISSUE:

Should the SWRCB adopt a proposed resolution authorizing the Executive Director or his designee to amend the DFG interagency agreement to add funds for SMWP equipment replacement in

FY 1997-98?

FISCAL IMPACT: The proposed amendment would add $145,000 of General Funds to the SMWP interagency agreement for FY 1997-98. With the addition of $145,000, the total contract amount would not exceed $445,000.

WHEREAS:

  3. 3. Water Code Section 13177, which became effective on January 1, 1998, appropriates $145,000 from the General Fund to the SWRCB for use in the SMWP.


THEREFORE BE IT RESOLVED THAT:

The SWRCB authorizes the Executive Director or his designee to amend the DFG interagency agreement to add $145,000 for SMWP equipment replacement in

FY 1997-98.
