SUBJECT: | C0NSIDERATION OF A RESOLUTION TO AUTHORIZE THE EXECUTIVE DIRECTOR TO AMEND THE INTERAGENCY AGREEMENT WITH THE DEPARTMENT OF FISH AND GAME FOR THE BAY PROTECTION AND TOXIC CLEANUP PROGRAM MONITORING SERVICES |
DISCUSSION: | The Bay Protection and Toxic Cleanup Program (BPTCP) is required by the Water Code (Section 13390-13396.7) to monitor the State's enclosed bays and estuaries to identify toxic hot spots and plan for the cleanup. The California Department of Fish and Game (DFG) is the primary contractor for monitoring services for the BPTCP. The State Water Resources Control Board (SWRCB) staff will continue to implement the monitoring contract with DFG to provide the necessary monitoring services. Seven coastal Regional Water Quality Control Boards (RWQCBS) implement regional monitoring for the BPTCP through task orders developed in coordination with DFG and SWRCB staff. In the final year of the BPTCP, DFG will prepare written reports on all monitoring data. A portion of the funds will be used to complete a limited number of measurements on archived samples. The BPTCP has been recently directed to complete Regional and Statewide Toxic Hot Spot Cleanup Plans by the legislatively mandated deadlines. The existing DFG interagency agreement ends June 30, 1998. In order to fully comply with the stated request as well as meet all requirements set forth in Water Code Section 13390-13396, the BPTCP will need the continued technical support of the DFG for all the monitoring data reports. For this reason it will be necessary to extend the existing term of the DFG contract by one year until June 30, 1999. Working with the Budget Office we have estimated that there are sufficient FY 1997-98 funds in the BPTCF to increase the BPTCP budget by $100,000. This additional revenue is the result of late fee payment received by the San Francisco Bay and Central Valley RWQCBs. We propose augmenting the DFG contract by $78,000 to cover additional sampling at one site in the San Francisco Bay RWQCB and for completion of reports for the Central Valley RWQCB. The interagency agreement now in effect will be amended to increase the contract amount by $78,000 for FY 1997-98 work. The contract dollar amount will increase to a total of $2,973,159. In addition, the term of the contract will be extended by one year to June 30, 1999 to accommodate all the work mandated by the Water Code now required to be completed. |

The proposal will also extend the contract term for one more year for DFG's technical support until the BPTCP ends (June 30, 1999). |

WHEREAS:
1. | The Bay Protection and Toxic Cleanup Program (BPTCP) was established by the State Water Resources Control Board (SWRCB) to implement the requirements of Section 13390 et seq. of the Water Code which include the development of surveillance and monitoring programs for enclosed bays and estuaries of the State. |
2. | Seven coastal Regional Water Quality Control Boards (RWQCBs) and the SWRCB implement regional monitoring for the BPTCP though an interagency agreement with the Department of Fish and Game (DFG). |
3. | The current interagency agreement is a three year task order contract. |
4. | The interagency agreement now in effect will increase the contract dollar amount by $78,000 from $2,895,159 to $2,973,159 to complete program monitoring reports. |
5. | The term of the contract specified in the interagency agreement now in effect will be extended by one year to June 30, 1999. |
THEREFORE BE IT RESOLVED THAT:
1. | The SWRCB authorizes the Executive Director or his designee to amend the interagency agreement with the DFG to increase the contract by $78,000 for FY 1997-98 subject to the availability of funds from the BPTCP annual fees. |
2. | The SWRCB authorizes the Executive Director or his designee to amend the interagency agreement with the DFG to extend the term limit by one year until June 30, 1999. |
