ITEM 6: RECOMMITMENT OF STATE REVOLVING FUND (SRF) LOANS FOR THE CONSTRUCTION OF RANKIN STREET PUMP STATION AND SOUTHEAST WATER POLLUTION CONTROL PLANT IMPROVEMENTS, CONTRACTS "4" AND "5", AND, THE CONSTRUCTION OF ISLAIS CREEK TRANSPORT AND STORAGE FACILITIES, CONTRACTS "B" AND "E", CITY AND COUNTY OF SAN FRANCISCO (CITY), PROJECT NOS. C-06-4025-252, 260, 420 AND 451

DISCUSSION: On February 20, 1997, the State Water Resources Control Board (SWRCB) committed $50 million in SRF loan funds to the City for the construction of Rankin Street Pump Station and Southeast Water Pollution Control Plant Improvements, Contracts "4" & "5" and Islais Creek Transport and Storage Facilities, Contracts "B" & "E" in Resolution No. 97-010 (Attachment 1). The SWRCB decommitted the $50 million in SRF funding on April 16, 1998 in Resolution No. 98-029 (Attachment 2) because the City was unable to accept loans from the SWRCB due to an inadvertent change which occurred during City Charter reform. The voters in San Francisco approved a City Charter amendment on the June 1998 Ballot restoring the authority to request and accept SRF loans. The City is now prepared to accept new SRF loans. The City has requested the SWRCB to recommit the $50 million in SRF funding previously committed to the City (Attachment 3) for the four projects listed.

POLICY ISSUE: Should the SWRCB recommit the funding previously committed to the City?

FISCAL IMPACT: According to SWRCB Resolution No. 97-001 (Approval of a Staff Proposal to Better Manage the SRF Repayment Account), the SWRCB may approve preliminary loan commitments against the current FFY account and against 125 percent of future repayment funds based on scheduled loan dates.

RWQCB IMPACT: Completion of this project will allow the San Francisco Bay RWQCB to achieve its goal of reducing the untreated wastewater overflows to the San Francisco Bay in wet weather.

STAFF RECOMMENDATION: That the SWRCB adopt a resolution recommitting only $50 million SRF loan funds at this time for the Construction of Rankin Street Pump Station and Southeast Water Pollution Control Plant Improvements, Contracts "4" and "5" and the construction of Islais Creek Transport and Storage Facilities, Contracts "B" & "E All of these projects have been constructed by the City and they are in operation now. The balance above is all that will be available for other projects through September, 1999.

RECOMMITMENT OF STATE REVOLVING FUND LOANS

FOR THE CONSTRUCTION OF RANKIN STREET PUMP STATION AND SOUTHEAST WATER POLLUTION CONTROL PLANT IMPROVEMENTS, CONTRACTS "4" AND "5" AND THE CONSTRUCTION OF ISLAIS CREEK TRANSPORT AND STORAGE FACILITIES CONTRACTS "B" AND "E"

CITY AND COUNTY OF SAN FRANCISCO (CITY), STATE REVOLVING FUND LOAN NO. PROJECT NOS. C-06-4025-252, 260, 420 AND 451

WHEREAS:

On February 20, 1997, the State Water Resources Control Board (SWRCB) committed (per resolution No. 97-010) a total of $50 million of State Revolving Funds to the City and County of San Francisco (City) for the construction of Rankin Street Pump Station and Southeast Water Pollution Control Plant Improvements, Contracts "4" & "5" and Islais Creek Transport and Storage Facilities, Contracts "B" & "E";

The SWRCB decommitted the funding (per Resolution No. 98-029) on April 16, 1998 because the City was unable to accept loans from the SWRCB due to City Charter reform; and

The voters in San Francisco approved a City Charter amendment restoring the City's ability to accept SRF loans on the June 1998 Ballot and the City has requested recommitment of SRF loans and is now prepared to accept new SRF loans.

THEREFORE BE IT RESOLVED THAT:

The State Water Resources Control Board recommits State Revolving Fund loan funding of only $50 million to the City and County of San Francisco for the construction of Rankin Street Pump Station and Southeast Water Pollution Control Plant Improvements, Contracts "4" & "5" and Islais Creek Transport and Storage Facilities, Contracts "B" & "E", with a repayment period of 20 years, and the first repayment due one year after the first loan disbursement.
