Regional Board Conclusion: | Fecal indicator bacteria (which includes enterococcus, fecal coliform, and total coliform) are being considered for placement on the Section 303(d) list under Section 3.3 of the Listing Policy. Under this section a single line of evidence (LOE) is necessary to assess listing status. Five LOEs were available for the assessment of water contact recreation beneficial use (REC-1). One LOE was available for the assessment of shellfish harvesting beneficial use (SHELL).
Data from LOE 44731 were re-evaluated with LOEs 133711 and 133638. Data from LOE 32688 were re-evaluated with LOEs 133640 and 133702. Data from LOEs 345 and 46783 were re-evaluated with LOEs 133711, 133638, 133640, and 133702. Data from LOEs 47604 and 47605 were re-evaluated with LOE 133596. The data assessed are ocean beach fecal indicator bacteria data collected in accordance with AB411 (Chapter 765, Statutes of 1997) requirements. In accordance with Section 3.3 of the Listing Policy a 4% exceedance rate shall be used to add waters from the List "if water quality monitoring was conducted April 1 through October 31 only". However, the data assessed in this decision include data collected during months outside the April - October range. Therefore, this pollutant was assessed at the 10% exceedance. LOEs 133711 and 133702 were not used in this assessment as they were assessed at a 4% exceedance rate. The following summary presents the total exceedances and number of samples used in this assessment: 1) 13 of 389 samples exceed the geometric mean objective for enterococcus for REC-1; 2) 9 of 122 samples exceed the Statistical Threshold Value (STV) objective for enterococcus for REC-1; 3) 5 of 181 samples exceed the single sample maximum for fecal coliform for REC-1; 4) 0 of 117 samples exceed the geometric mean objective for fecal coliform for REC-1; and 5) 37 of 479 samples exceed the median concentration objective for total coliform for SHELL. Based on the readily available data and information, the weight of evidence indicates that there is insufficient justification for adding this water segment-pollutant combination to the Section 303(d) list. This conclusion is based on the staff findings that: (1) The data used satisfy the data quality requirements of Section 6.1.4 of the Policy. (2) The data used satisfy the data quantity requirements of Section 6.1.5 of the Policy. (3) Enterococcus, fecal coliform, and total coliform samples do not exceed the objectives more than the allowable frequency identified in Sections 3.2 (2006 data) and 3.3 (2010 and beyond) of the Listing Policy.
