Regional Board Conclusion: This pollutant is being considered for removal on the CWA section 303(d) List under sections 2.2 and 4.1 of the Listing Policy. Under 4.1 of the Policy, a minimum of one line of evidence is needed to assess listing status.

Two lines of evidence are available in the administrative record to assess this pollutant.

One placeholder decision for a CWA section 303(d) Listing made in a previous assessment cycle exceed the Guideline.
Zero of one samples exceed the Guideline.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the CWA section 303(d) List. There is sufficient justification to place it in the Being Addressed portion of the CWA 303(d) List because a TMDL has been completed and approved by RWQCB and USEPA, and is expected to result in attainment of the standard.

Two lines of evidence are available in the administrative record to assess this pollutant.

The Calleguas Creek Historic Pesticides TMDL was approved by the RWQCB in 2005 and subsequently approved by USEPA.

Based on the readily available information, the weight of evidence indicates that there is sufficient justification in favor of placing this water segment-pollutant combination in the Water Quality Limited Segments Being Addressed portion of the section 303(d) list.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. Two of four and one of one samples exceeded the OEHHA Screening Value. However, a TMDL is in place to address this pollutant in this water body.
4. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Larry Walker and Associates proposed deleting 61 of these data points in their analysis for the Calleguas Creek Characterization Study. There were 49 points LWA proposed keeping; combined with the 26, the number of samples is 75. There were 7 out of 75 which exceeded the CTR (CCWMP, 2006).
