Under this section when all other listing factors do not result in the listing of a water segment but information indicates non-attainment of standards, a water segment shall be evaluated to determine whether the weight of evidence demonstrates that water quality standard is not attained. If the weight of evidence indicates non-attainment, the water segment shall be placed on the CWA section 303(d) List.
Two lines of evidence are available in the administrative record to assess this pollutant that are both based on the same fish tissue data assessed for COMM and WILD. A new mercury objective was recently adopted so the tissue data from previous integrated reports cycles was reassessed with the new objective to create updated lines of evidence. LOE # 47541 and LOE # 45420 are replaced by LOE # 133228 for COMM and LOE # 133058, which assesses the tissue data against the WILD tissue objective for mercury.. Zero of one samples exceed the COMM objective and zero of one samples exceed the WILD objective for mercury. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the CWA section 303(d) List in the Water Quality Limited Segments category. Total mercury is usually analyzed for most fish studies and assumed to be 100 percent methylmercury for the purposes of risk assessment (Klasing & Brodberg 2008). The fish consumption rate of 32 g/day is considered more protective of human health since recommendations are now to eat one meal per week of fish to obtain necessary Omega-3 nutrition. The fish consumption rate of 32 g/day is also protective of wildlife, as it protects 6 out of 7 endangered species. | ||||

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the section 303(d) list. There is sufficient justification to place it in the Being Addressed portion of the 303(d) list because a TMDL has been completed and approved by RWQCB and USEPA, and is expected to result in attainment of the standard. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category. The Lahontan Basin Plan's narrative pH objective (Chapter 3) is an antidegradation-based objective that requires that changes in normal ambient pH levels shall not exceed 0.5 pH units for waterbodies designated for the COLD or WARM beneficial uses. (A pH range of 6.5 to 8.5 units applies to "all other waters.") Though the 2012 LOE for pH (LOE ID #33847) indicates 125 out of 275 samples exceed the water quality objective, we can not determine that these are true exceedances since the normal ambient pH of this waterbody has not been established. Listing Policy section 3.10 contains direction for assessment based on trends in water quality. Even though there are 275 samples collected over a 31 year period, no data analysis has been done as of yet to determine baseline conditions (including diel, seasonal, annual and interannual variations). |

Regional Board Conclusion: | This pollutant is being considered for placement on the section 303(d) list under section 3.2 of the Listing Policy. Under section 3.2 a single line of evidence is necessary to assess listing status.
One line of evidence is available in the administrative record to assess this pollutant. Nineteen of the 95 samples fell below 7.0 mg/L dissolved oxygen (DO) which violated the water quality objective; however, reporting from STPUD several years after installation of a hypolimnetic oxygenation system indicates DO levels are improving as expected. Additionally, in 2003, USEPA approved a TMDL for phosphorus at Indian Creek Reservoir. As part of that TMDL, there are target concentrations for dissolved oxygen that must be met at an interim and long term value. The interim target value of a 30 day mean 6.5 mg/L, 7 day mean minimum of 5.0 mg/L, or a one day minimum of 4.0 mg/L must be met by 2013, To account for this target, the responsible party, the South Tahoe Public Utility District, acquired a grant (CWA 319(h) non-point source grant #06-244-556-0) to implement a hypolimnetic system in the reservoir. The hypolimnetic system was installed in 2007 and R6 staff managed the grant. STPUD consistently monitors the water column for DO once a month and voluntarily provides R6 staff with an annual monitoring report to track levels of DO at the reservoir. At the deepest sampling site on the reservoir, DO concentrations have significantly improved and are almost consistently meeting the one day minimum of 4.0 mg/L. The current phosphorus TMDL includes target values for DO to meet the requirements of the TMDL and STPUD has taken measurable efforts by installing a hypolimnetic system to improve DO in the reservoir. These implementation tactics align with the same tools that would be required for a separate TMDL specific to DO. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification in favor of placing this water segment-pollutant combination on the section 303(d) list in the Water Quality Limited Segments category. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Nineteen of the 95 samples exceed the objective and this exceeds the allowable frequency listed in Table 3.2 of the Listing Policy. 4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met. |
