Regional Board Conclusion:	This pollutant is being considered for removal from the CWA section 303(d) List under section 4.11 of the Listing Policy. Under this section when all other delisting factors do not result in the delisting of a water segment but information indicates attainment of standards, a water segment shall be evaluated to determine whether the weight of evidence demonstrates that water quality standard is attained. If the weight of evidence indicates attainment, the water segment shall be removed from the CWA section 303(d) List. Two lines of evidence were used in this assessment. LOE 2802 was not considered in this assessment as those data were collected prior to the approval of a TMDL and thus are no longer considered representative of conditions in the water body. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification for removing this water segment-pollutant combination from the CWA section 303(d) List. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. Diazinon and chlorpyrifos are the most prevalent of the organophosphate pesticides. 3. In October of 2007 USEPA approved a TMDL to control diazinon and chlorpyrifos in the Sacramento-San San Joaquin River Delta. 4. The following information indicates that the water quality standard is attained: following approval of the TMDL zero of 21 samples of diazinon and zero of 27 samples of chlorpyrifos exceed the objective for WARM. This is sufficient to determine beneficial use support according to the Listing Policy. 3. This process is scientifically defensible and reproducible.

Regional Board Decision Recommendation:	After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should be removed from the section 303(d) list because applicable water quality standards for the pollutant are not being exceeded.
