Decision This water segment is being considered for listing under section 2.2 of the Listing Policy. Under this section of the Policy, a minimum of one line of evidence is needed to assess listing status. One line of evidence is available in the administrative record to assess this pollutant. A remedial program other than a TMDL has been developed, approved, and is being implemented. This program is expected to result in attainment of the standard. This water segment-pollutant combination (Leviathan Creek - Metals/Metalloids) was moved off the section 303(d) list during this (2006) listing cycle. Based on the readily available information, the weight of evidence indicates that there is sufficient justification in favor of placing this water segment-pollutant combination in the Water Quality Limited Segments Being Addressed portion of the section 303(d) list. |

Data Used to Assess Water Quality: | An alternative enforceable program, which is the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), is in place that will address metals and other acid mine drainage associated with the exceedances of water quality standards for this water segment. In May 2000, the USEPA placed the Leviathan mine on the CERCLA National Priorities List (NPL), thus making Leviathan mine a Superfund site. The cleanup process at Leviathan mine is required to meet all environmental requirements, or ARARs (applicable or relevant and appropriate requirements) during its operation.
The Leviathan mine is in the Remedial Investigation/Feasibility Study stage of the CERCLA process. A Record of Decision is expected in 2010. |
