| Regional Board Conclusion: | In 2012, the Regional Board revised its Basin Plan with new Pathogen Bacteria Indicator Objectives for REC-1(Resolution No. R8-2012-001, approved by USEPA in 2015). In general, the primary objective is <126 E. coli organisms per 100 mL as a geomean of at least 5 samples in a running 30-day period (there were additional provisions for specific waters through UAAs, a high flow suspension provision and use of Single Sample Maximums for posting and for the case where limited data prevents the calculation of geomeans. As a result these Enterococcus, Fecal Coliform and Total Coliform LOEs will be retired. Further, the Single Sample objective was only used because of the lack of representative 30-day, 5-sample Geomean values, as per the Region 8 Basin Plan (2016 update) on page 4-17, footnote 3. When representative 30-day, 5-sample Geomean values are collected the Single Sample E. coli LOEs will be retired.
This pollutant is being considered for placement on the CWA section 303(d) List under section 3.2 of the Listing Policy. Under section 3.2 a single line of evidence is necessary to assess listing status. Two lines of evidence are available in the administrative record to assess this pollutant. Two of the thirty-two samples exceed the water quality objective. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification in favor of removing this water segment-pollutant combination from the CWA section 303(d) List. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Two of Thirty-two samples exceed the water quality objective and this does exceed the allowable frequency listed in Table 3.2 of the Listing Policy. 4. While this water body was listed for "Pathogens" in 1998 and the data responsible for the "Pathogen" listing is no longer available. Further, it is likely that the data responsible for the 1998 "Pathogen" listing was not for E. coli concentrations, but rather for Enterococcus, Fecal Coliform or Total Coliforms, which no longer are used for Indicator Bacteria water quality objectives in Region 8. Therefore, this 1998 "Pathogen" listing has not been used in this assessment and the available E. coli data has been compared to Table 3.2 of the Listing Policy to determine if there is sufficient evidence to list based on the new water quality objective. 4. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met. This pollutant is being considered for placement on the CWA section 303(d) List under section 3.2 of the Listing Policy. This water segment is also on the CWA section 303(d) List for toxicity to invertebrate test organisms in water samples. Based on the readily available data and information, the weight of evidence provides sufficient justification against placing Benthic Community Effects in this water segment on the CWA section 303(d) List. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2.
