Region 3
Pacific Ocean at East Beach (mouth of Mission Creek, Santa Barbara County)

Pollutant: Enterococcus
Final Listing Decision: Do Not Delist from 303(d) list (TMDL required list)
Last Listing Cycle's Final Listing Decision: Do Not Delist from 303(d) list (TMDL required list)(2016)
Revision Status Original

Expected TMDL Completion Date: 2027
Impairment from Pollutant or Pollution: Pollutant

Regional Board Conclusion: This pollutant is being considered for removal from the section 303(d) list under sections 4.2 and 4.3 of the Listing Policy. Under these sections, a single line of evidence is necessary to assess listing status.

Four lines of evidence are available in the administrative record to assess this pollutant. Forty six of 273 samples exceeded the geometric mean standard for enterococcus (LOEs 19557 and 56444) and 79 of 329 samples exceeded the single sample maximum for enterococcus (LOEs 19558 and 56443) for the water contact recreation water quality standard (Water Quality Control Plan: Ocean Waters of California, SWRCB, 2005).

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the section 303(d) list.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. Forty six of 273 samples exceeded the geometric mean standard for enterococcus (LOEs 19557 and 56444) and 79 of 329 samples exceeded the single sample maximum for enterococcus (LOEs 19558 and 56443) for the water contact recreation water quality standard and this exceeds the allowable frequency listed in Table 4.2 of the Listing Policy.
4. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are met.

Regional Board Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be removed from the section 303(d) list because applicable water quality standards for the pollutant are being exceeded.

State Board Review of Regional Board Conclusion and Recommendation:

State Board Decision Recommendation: After review of this Regional Board decision, SWRCB staff recommend the decision be approved by the State Board.

96018
Region 3
Pacific Ocean at East Beach (mouth of Mission Creek, Santa Barbara County)

Pollutant: Fecal Coliform
Final Listing Decision: Do Not Delist from 303(d) list (TMDL required list)
Last Listing Cycle's Final Listing Decision: Do Not Delist from 303(d) list (TMDL required list)(2016)
Revision Status Original
Sources: A Source Unknown
Expected TMDL Completion Date: 2027
Impairment from Pollutant or Pollution: Pollutant

Regional Board Conclusion: This pollutant is being considered for removal from the section 303(d) list under sections 4.2 and 4.3 of the Listing Policy. Under these sections, a single line of evidence is necessary to assess listing status.

It should be noted that the data collected between 2007 and 2010 are E. coli results that are evaluated using the Ocean Plan Objective for Fecal Coliform. This objective is higher than the USEPA recreation criteria for E. coli. Evaluation of the data using the Fecal Coliform Objective could result in an erroneous decision to remove the beach segment from the 303(d) List and are not used here as the basis of a decision to de-list.

Five lines of evidence are available in the administrative record to assess this pollutant. Eight of 173 samples exceeded the geometric mean standard for fecal coliform (LOEs 19555 and 56446) and 45 of 328 samples exceeded the single sample maximum for fecal coliform (LOEs 19556 and 56445) for the water contact recreation water quality standard (Water Quality Control Plan: Ocean Waters of California, SWRCB, 2005). The data associated with the original listing (LOE 3981 - placeholder reference for assessments made prior to the 2006) is no longer available. However, the most recent six years of data show that the beneficial use is being fully supported.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification for removing this water segment-pollutant combination from the section 303(d) list.

This conclusion is based on the staff findings that:
1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy.
2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy.
3. Although 8 of 173 samples exceeded the geometric mean standard for fecal coliform (LOEs 19555 and 56446) and 45 of 328 samples exceeded the single sample maximum for fecal coliform (LOEs 19556 and 56445) for the water contact recreation water quality standard and this does not exceed the allowable frequency listed in Table 4.2 of the Listing Policy, some of these data are for E. coli and are incorrectly compared to the Fecal Coliform Objective. Therefore the decision must remain Do Not De-List..
4. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are not met.

Regional Board Decision Recommendation: After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be removed from the section 303(d) List because applicable water quality standards for the pollutant are not used in this assessment. Some of the data included here are E. coli data and those data should not be assessed using the Fecal Coliform Objective.

State Board Decision Recommendation: After review of this Regional Board decision, SWRCB staff recommend the decision be approved by the State Board.

Regional Board Conclusion: This pollutant is being considered for removal from the section 303(d) list under sections 4.2 and 4.3 of the Listing Policy. Under these sections, a single line of evidence is necessary to assess listing status.

Eight lines of evidence are available in the administrative record to assess this pollutant. Sixty four of 153 samples exceeded the shellfish harvesting water quality objective (Water Quality Control Plan: Ocean Waters of California, SWRCB, 2009). The data associated with the original listing (LOE 3982 - placeholder reference for assessments made prior to the 2006) is no longer available. However, the most recent six years of data show that the beneficial use is not being fully supported.

Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the section 303(d) list.
