Regional Board Conclusion:	This pollutant is being considered for removal from the CWA section 303(d) List under section 4.2 of the Listing Policy. Under section 4.2 a single line of evidence is necessary to assess listing status. Thirty Seven (37) lines of evidence are available in the administrative record to assess this pollutant. Two hundred and Forty Eight (248) of 2513 samples exceed the Enterococcus Geomean Objective. Twenty Seven (27) of 291 samples exceed the Enterococcus Single Sample Objective. Sixty Five (65) of 2645 samples exceed the Fecal Coliform Geomean Objective. Seventeen (17) of 284 samples exceed the Fecal Coliform Single Sample Objective. Twenty Seven (27) of 3295 samples exceed the Total Coliform Geomean Objective. Three (3) of 282 samples exceed the Total Coliform Single Sample Objective. Two (2) of six (6) samples exceed the E. coli Single Sample Objective. Based on the readily available data and information, the weight of evidence indicates that there is not sufficient justification for removing this water segment-pollutant combination from the CWA section 303(d) List. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. Two hundred and Forty Eight (248) of the 2513 samples exceed the Enterococcus Geomean Objective, 65 of the 2645 samples exceed the Fecal Coliform Geomean Objective, 27 of the 3295 samples exceed the Total Coliform Geomean, and this does exceed the frequency listed in table 4.2 4. Twenty Seven (27) of the 291 samples exceed the Enterococcus Single Sample Objective, 17 of the 284 samples exceed the Fecal Coliform Single Sample Objective, Three (3) of the 282 samples exceed the Total Coliform Single Sample Objective, Two (2) of six(6) samples exceed the E. coli Single Sample Objective, and this does not exceed the frequency listed in table 4.2. 5. Pursuant to section 3.11 of the Listing Policy, no additional data and information are available indicating that standards are not met. 2010 listing cycle Decision Relationships: This pollutant is being considered for removal from the section 303(d) list under section 4.2 of the Listing Policy. Under this section a single line of evidence is necessary to assess listing status. Five (5) lines of evidence are available in the administrative record to assess this pollutant. Each line of evidence represents a station that was sampled. A total of 218 samples exceeded the water quality objective out of 2311 samples taken. The data indicates that there is continued impairment at the station on 1st Street. At the 1st Street station, one hundred fifty-five samples exceeded out of 537 samples taken. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the section 303(d) list. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. One hundred fifty-five of 537 samples exceeded the Ocean Plan Standard and this exceeds the allowable frequency listed in Table 4.2 of the Listing Policy. 4. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are met.

Regional Board Decision Recommendation:	After review of the available data and information, RWQCB staff concludes that the water body-pollutant combination should not be removed from the section 303(d) list because applicable water quality standards for the pollutant are being exceeded.

State Board Review of Regional Board Conclusion and Recommendation:	2010 listing cycle Decision Relationships: This pollutant is being considered for removal from the section 303(d) list under section 4.2 of the Listing Policy. Under this section a single line of evidence is necessary to assess listing status. Five (5) lines of evidence are available in the administrative record to assess this pollutant. Each line of evidence represents a station that was sampled. A total of 218 samples exceeded the water quality objective out of 2311 samples taken. The data indicates that there is continued impairment at the station on 1st Street. At the 1st Street station, one hundred fifty-five samples exceeded out of 537 samples taken. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the section 303(d) list. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. Trash immediately distracts the eye at first glance and is densely located in and near the water body. Inspections of trash conditions, and cleanup efforts in the San Gabriel River Estuary were conducted on January 23, 2010. Numerous photos were taken and reviewed to assess trash conditions. All photos exhibit poor to very poor trash conditions within the estuary. The trash is too numerous to count, and the types of trash depicted in the photos include shopping carts, tires, toys, clothing, furniture, household items, bottles and cans.
