Regional Board Conclusion:	This pollutant is being considered for removal from the CWA section 303(d) List under section 4.3 of the Listing Policy. Under this section a single line of evidence is necessary to assess listing status. 5 lines of evidence are available in the administrative record to assess this pollutant. 35 of 316 samples exceeded the geometric mean for Enterococcus. 16 of 111 samples exceeded the statistical threshold value for Enterococcus. 0 of 1 sample exceeded the simple sample maximum for fecal coliform. 0 of 1 samples exceeded the median total coliform objective for shellfish harvesting. LOE 89358 (107 out of 159 exceedances) is being considered for assessment because although it is from a previous cycle, it uses the current water quality objective for total coliform to support shellfish harvesting. It was added to LOE 302005 (0 out of 1 exceedances) In 107 of 160 thirty-day periods, 10% or more of the samples exceeded the shellfish harvesting objective for total coliform. Based on the readily available data and information, the weight of evidence indicates that there is sufficient justification against removing this water segment-pollutant combination from the CWA section 303(d) List. This conclusion is based on the staff findings that: 1. The data used satisfies the data quality requirements of section 6.1.4 of the Policy. 2. The data used satisfies the data quantity requirements of section 6.1.5 of the Policy. 3. 107 of 160 samples exceeded the shellfish harvesting objective for total coliform and this exceeds the allowable frequency listed in Table 4.2 of the Listing Policy. 4. Pursuant to section 4.11 of the Listing Policy, no additional data and information are available indicating that standards are met.
