- General WDRs and General NPDES Permit for Existing Milk Cow Dairy Concentrated Animal Feeding Operations (CAFOs)
(This General Order was rescinded on 20 February 2020 and will not be replaced.)- Board Order No. R5-2010-0118 was revised by Order R5-2011-0091 in response to the decision of the United States Court of Appeals for the Fifth Circuit in National Pork Producers Council, et al v. United States Environmental Protection Agency (5th Cir 2011) 635 F 3d 738. The Fifth Circuit Court decision vacated all provisions of the 20 November 2008 EPA Final Rule that require Concentrated Animal Feeding Operations (CAFOs) that "propose to discharge" to apply for an NPDES permit. Board Order R5-2011-0091 changed Board Order R5-2010-0118 to remove the "propose to discharge" language. Order R5-2011-0091 also made corresponding changes to Attachments F and H, renumbered the table of contents as needed, and made minor changes to Attachments D and G to insert the correct order number into the text. As Order R5-2011-0091 simply modifies Order R5-2010-0118, R5-2011-0091 does not exist as a separate order and the Expiration Date of Order R5-2010-0118 has not changed.
