Mandatory Minimum Penalty for California Department of Fish And Wildlife-Fish Springs Fish Hatchery
Overview
California Department of Fish and Wildlife (DFW) has been notified that it is in violation of Lahontan Regional Water Quality Control Board (Water Board) Order No. R6V-2006-0030, NPDES Permit No. CA0102806 (permit). The permit was adopted by the Water Board on June 14, 2006, and establishes waste discharge requirements for the discharge of waste from Fish Springs Fish Hatchery to Fish Springs Creek. The MMP alleges the DFW violated the effluent limits on three occasions.
On March 12, 2016, CDFW signed the Acceptance of Conditional Resolution and Waiver of Right to Hearing; proposed Order. There is a proposed settlement between the Lahontan Regional Water Board and the California Department of Fish and Wildlife to pay $9,000 in statutory mandated minimum penalties of $3,000 per violation for effluent limit violation(s). The violations occurred at the Fish Springs Fish Hatchery located in Big Pine, Inyo County. The public comment period is open until 5:00 p.m. on May 5, 2016.
