Administrative Civil Liability Settlement Agreement with Tahoe Keys Marina, El Dorado County

Overview

Discharges of storm water from the Tahoe Keys Marina are regulated under the Lahontan Water Board’s General Waste Discharge Requirements and National Pollutant Discharge Elimination System Permit for Storm Water Runoff Associated with Marina Operations in the Lake Tahoe Hydrologic Unit, Board Order No. R6T-2016-0038 (Marina General Permit). The Tahoe Keys Marina was also enrolled in the previous Marina General Permit, Order No. R6T-2011-0024.

The Lahontan Water Board’s Prosecution Team alleges that Tahoe Keys Marina is subject to $42,000 in mandatory minimum penalties for discharges of storm water to Lake Tahoe that exceeded effluent limitations found in the Marina General Permit. These violations took place between November 1, 2011 and December 31, 2021.

Tahoe Keys Marina and Yacht Club, LLC has agreed to settle the proposed penalty by (a) paying $42,000 to the State Water Pollution Cleanup and Abatement Account and (b) waiving its right to a public hearing. The Lahontan Water Board’s Prosecution Team has agreed to this proposal and has released the tentative settlement agreement for a 30-day public comment period. No public comments were received.

On April 14, 2023, the Lahontan Water Board’s Executive Officer, acting on behalf of the Lahontan Water Board, signed Settlement Agreement No. R6T-2023-0003.
