Discharger or Responsible Party: Stuart and Eric Depper
Alleged Violation: Failure to submit technical reports.
Proposed Penalty: $88,000
Current Status: An Administrative Civil Liability Complaint and a Site Cleanup Requirement have been issued; Remediation of the site is in progress and there will be a future opportunity to comment on a settlement or attend a public hearing regarding this case.
Discharger or Responsible Party: SODA LLC
Alleged Violation: Failure to submit annual report.
Proposed Penalty: $2,910.00

Discharger or Responsible Party: LP Acquisitions LLC
Alleged Violation: Failure to submit annual report.
Proposed Penalty: $2,910.00
Current Status: An Administrative Civil Liability Complaint has been issued. The San Francisco Bay Regional Water Quality Control Board Executive Officer will hold a hearing to consider the matter on December 11, 2024, at 2:30 pm. More details are available in the Revised Notice of Hearing and Final Hearing Procedure. The attachment documents referred to in the ACL Complaint are available upon request. Discharger or Responsible Party: Martinez Refining Company LLC
Alleged Violation: Five alleged violations for effluent limit violations (between January and July 2023), prohibited discharges to a marsh (in October 2022 and January 2023), and a reporting violation (February 2022).
Proposed Penalty: $4,482,000
Current Status: A Tentative (settlement) Order has been issued; the public comment period is open until December 2, 2024, by 5:00 p.m.
