Enforcement Reports Overview

The Office of Enforcement (OE) prepares and/or coordinates reports on the effectiveness of Water Board enforcement activities. The Water Boards' Water Quality Enforcement Policy articulates enforcement expectations and priorities for the State and the nine Regional Water Boards. OE is responsible for updating the Water Quality Enforcement Policy and evaluating performance metrics for enforcement effectiveness.

Annual Performance Reports - Enforcement

To navigate to the annual Performance Report’s Enforcement section, select the center “Enforce” tab under the heading, What We Do and How We Are Doing. From there you can select, “View the Annual Enforcement Reports.” You will find a summary of all water quality enforcement actions taken in the state across all programs and also a breakdown by program. More detailed reports can be found under the heading, Data Reported.

State Water Board Legislatively Mandated Reports

Pursuant to California Water Code (CWC) 13385(o), the State Water Board is required to annually prepare a 13385(o) Enforcement Report that includes information on violations, enforcement actions, and the effectiveness of current enforcement policies, including mandatory minimum penalties. This requirement pertains to National Pollutant Discharge Elimination System (NPDES) wastewater and stormwater facilities within California.

Pursuant to CWC 13399.27, the State Water Board is required to annually prepare a 13399.27 Enforcement Report with information on violations and enforcement actions taken by the Regional Water Boards on those that failed to obtain an applicable storm water permit or submit an annual report. This requirement pertains to National Pollutant Discharge Elimination System (NPDES) storm water facilities within California.

U.S. EPA State Review Framework Report

The State Review Framework (SRF) assesses U.S. EPA and state enforcement of the Clean Water Act (CWA), the Clean Air Act (CAA), and the Resource Conservation and Recovery Act (RCRA). U.S. EPA works in partnership with each state to create a final SRF report. These SRF reports allow U.S. EPA to identify recommendations for improvement to ensure fair and consistent enforcement and compliance programs across the states. The most recent report was evaluated over Federal Fiscal Year 2019 (October 1, 2018 to September 30, 2019).
