On September 24, 2015, the California Department of Water Resources (DWR) filed an application for water quality certification under section 401 of the Clean Water Act with the State Water Resources Control Board (State Water Board) for the California WaterFix Project (Project). For information on a separate, but related petition filed by DWR and the U.S. Bureau of Reclamation requesting changes in water rights for the State Water Project and Central Valley Project associated with the California WaterFix Project, please see the Water Right Change Petition webpage. In its February 11, 2016, Pre-Hearing Conference Ruling, the State Water Board Hearing Officers determined that “In order to ensure that parties do not have to duplicate their participation in two proceedings [water right change petition and water quality certification for the California WaterFix] with overlapping issues, and to allow the decisions on the 401 Application to be informed by the significant information that will be produced in the hearing process, the Executive Director will not issue a decisions on the 401 Application until after the hearing record for the water right petition closes... the State Water Board plans to process and act on the 401 Application separately.”
