Clean Water Act Section 401 – Certification and Wetlands Program
General Orders
Projects that involve discharges to waters of the state in more than one region are under the jurisdiction of the State Water Resources Control Board (State Water Board). Regional Water Quality Control Boards issue orders for projects that fall within their jurisdiction, with the exception of orders for enrollment under Nationwide Permits 12, 57, and 58, which are issued by the State Water Board. The following certification orders have been issued by the State Water Board.

2026 State Water Board Nationwide Permits General Order for Waste Discharge Requirements for Discharges of Dredged or Fill Materials to Waters of the State and Partial Clean Water Act Section 401 Water Quality Certification and Partial Denial of the U.S. Army Corps of Engineers’ (Corps) 2026 Nationwide Permits. Order No. WQ 2025-0066-DWQ Effective March 15, 2026 The General Order conditionally certifies 19 and denies 38 of the Corps Nationwide Permits (NWPs). Certification is granted to NWPs 1, 3(a), 4, 5, 6, 9, 10, 11, 12, 13, 14, 20, 22, 28, 32, 36, 54, 57, and 58, subject to the General Order’s terms and conditions. All other NWPs are denied. This General Order also serves as waste discharge requirements for projects that qualify for enrollment in an NWP but are not required to obtain a federal permit or license because the affected waters are not waters of the United States. 2026 Nationwide Permits General Order and Attachments
